1. General Conditions

• You must be at least 18 years old to purchase nicotine products from our store.
• By agreeing to these Terms, you represent that you are of legal age in your country of residence.
• We reserve the right to refuse service to anyone for any reason at any time.
• These Terms may be updated from time to time. The version posted on our website at the time of your order applies.

2. Products and Availability

• Our products are nicotine pouches and may contain nicotine, an addictive substance.
• Product descriptions and prices are subject to change without notice.
• We reserve the right to discontinue any product at any time.

3. Orders and Payment

• Orders are accepted through our website.
• Prices are shown in EUR or CZK, depending on your selection.
• Payments are processed securely through Shopify’s payment providers.
• By placing an order, you confirm that the payment information provided is valid and authorized.

4. Shipping

• We ship orders from Denmark. Orders to customers in the EU are delivered via DHL (partnered with GLS for first-leg transport).
• Delivery times and costs are shown at checkout.
• We are not responsible for delays caused by the carrier or customs authorities.

5. Returns and Refunds

• You have the right to return unopened products within 14 days of delivery, in accordance with EU consumer law.
• To initiate a return, you must contact us at tjr@pouchperfect.eu before sending items back.
• Returns must be unused, sealed, and in original packaging.
• Refunds will be processed within 14 days of receiving the returned goods, using the original payment method.
• Shipping costs are non-refundable, unless the product was faulty or incorrectly supplied.

6. Limitation of Liability

• Our products are intended for adult consumers only.
• We are not liable for misuse of products or for health consequences associated with nicotine consumption.
• To the maximum extent permitted by law, our liability is limited to the amount you paid for the product.

7. Customer Responsibility for Import and Customs

• Customers are solely responsible for ensuring that the products they order are permitted in their country of import, and for complying with all local laws and regulations regarding nicotine products.
• By purchasing from us, you acknowledge that you are the legal importer in your country and are responsible for declaration and payment of all customs duties, excise taxes, or other levies that may apply.
• PouchPerfect ApS operates from Denmark and does not remit excise taxes on behalf of customers abroad. For example, importing into Finland may require payment of local excise duties by the customer.
• We are not liable for fines, penalties, or confiscations of goods caused by non-compliance with local import rules. If unsure, consult your local customs office before placing an order.

8. Important Notice Regarding Wholesale Purchases with GLS

In the rare event that a package is discarded after delivery by GLS, PouchPerfect ApS cannot be held responsible for issuing a refund. As we do not receive refunds from GLS in such cases, we are unable to compensate for lost or discarded goods. While the likelihood is very small, we recommend customers take measures to secure their deliveries.

9. Governing Law and Jurisdiction

These Terms are governed by Danish law, excluding conflict-of-law rules. Disputes may be brought before the Danish courts, unless mandatory consumer law provides otherwise (e.g. you may also bring claims in your country of residence within the EU).
